Acceptable Usage Policy

It is Route2's intent to provide our customers with the best Internet service possible. To help us accomplish this, we have adopted an AUP. This policy outlines the acceptable use of the Route2 Internet service as well as acceptable conduct on the Internet using the Route2 Internet service. These policies and customer use policies are in addition to the information contained in the Route2 Internet Subscriber Agreement.

It is the responsibility of all Route2 Internet customers and all others who have access to Route2's network to comply with this policy. As a Route2 Internet customer it is your responsibility to secure computer equipment so that it is not subject to external threats such as viruses and other methods of intrusion. Failure to comply with this or any other Route2 policies could subject your account to suspension or termination. If you do not agree to comply with all of the terms of our policies, you must immediately stop use of the service and notify Route2 so that your account may be closed.

By using the Route2 Internet Service to reproduce, publish, display, transmit and distribute content, you warrant that the content complies with this Policy and that your actions do not constitute any prohibited use as set out in this AUP.

Prohibited uses include, but are not limited to, using the Route2 customer equipment (as defined in the Subscriber Agreement) or the Route2 service to:

  1. Restrict or inhibit any other user from using and enjoying services and/or the Internet;
  2. Undertake or accomplish any unlawful purpose. This includes, but is not limited to, posting, storing, transmitting or disseminating information, data or material which is libelous, obscene, unlawful, threatening, defamatory, or which infringes the intellectual property rights of any person or entity, or which in any way constitutes or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, provincial or federal law, order or regulation;
  3. Post, store, transmit or disseminate any information or material which a reasonable person could deem to be objectionable, offensive, indecent, pornographic, harassing, threatening, embarrassing, distressing, vulgar, hateful, racially or ethnically offensive or otherwise inappropriate, regardless of whether such material or its dissemination is unlawful;
  4. Access any other person's computer, software, or data without their knowledge and consent; breach the security of another user; or attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for customer, logging into or making use of a server or account customer is not expressly authorized to access, or probing the security of other hosts, networks or accounts;
  5. Use or distribute tools designed or used for compromising security, such as password guessing programs, decoders, password gatherers, analyzers, cracking tools, packet sniffers, encryption circumvention devices, or Trojan Horse programs. Network probing or port scanning tools are only permitted when used in conjunction with a residential home network, or if explicitly authorized by the destination host and/or network. Unauthorized port scanning, for any reason, is strictly prohibited;
  6. Upload, post, publish, transmit, reproduce, create derivative works of, or distribute in any way information, software or other material obtained through the Service or otherwise which is protected by copyright or other proprietary right, without obtaining permission of the owner;
  7. Copy, distribute or sublicense any software provided in connection with the service by Route2 or any third party, except that customer may make one copy of each software program for back-up purposes only;
  8. Restrict, inhibit or otherwise interfere with the ability of any other person, regardless of intent, purpose or knowledge, to use or enjoy the Service, including, without limitation, posting or transmitting any information or software which contains a worm, virus or other harmful feature, or generating levels of traffic sufficient to impede others' ability to send or retrieve information;
  9. Without permission from the owner of a system or network, doing any of the following:
    1. accessing the system or network
    2. monitoring data or traffic
    3. probing, scanning, testing firewalls
    4. testing the vulnerability of a system or network or
    5. breaching the security or authentication routines of a system or network;
  10. Restrict, inhibit, interfere with or otherwise disrupt or cause a performance degradation, regardless of intent, purpose or knowledge, to the Service or any Route2 (or Route2 supplier) host, server, backbone network, node or service, or otherwise cause a performance degradation to any Route2 (or supplier) facilities used to deliver the service.
  11. Resell the Service or otherwise make available to anyone outside the premises the ability to use the service (i.e. Wi-Fi, or other methods of networking). The service is for recreational, residential, personal and business use only and customer agrees not to use the Service for operation as an Internet Service Provider or for any other similar purpose
  12. Transmit unsolicited bulk or commercial messages or "spam". This includes, but is not limited to, unsolicited advertising, promotional materials or other solicitation material; bulk mailing of commercial advertising, chain mail, informational announcements, charity requests, and petitions for signatures; unless it is done with Route2 approval.
  13. Send numerous copies of the same or substantially similar messages, empty messages, or messages which contain no substantive content, or send very large messages or files to a recipient that disrupts a server, account, newsgroup, or chat service;
  14. Distribute programs that remove locks or time-outs built into software (cracks);
  15. Initiate, perpetuate, or in any way participate in any pyramid or other illegal soliciting scheme;
  16. Harvest e-mail addresses, screen names or other identifiers of others (without their prior express consent) or participate in "spidering"
  17. Collect responses from unsolicited messages;
  18. Impersonate any person or entity, engage in sender address falsification, forge anyone else's digital or manual signature, or perform any other similar fraudulent activity. Any policy set forth by another service provider accessed through the Service must be strictly adhered to.

Route2 reserves the right to change, modify add to and/or subtract Prohibited Uses from the terms of the AUP at any time, with or without notice to all concerned parties. If we change our Policy, we will post those changes on our web site in a timely manner.

Remedies

Violation of this Policy may result in civil or criminal liability, and Route2 may, in addition to any remedy that it may have at law or in equity, terminate permission for the User to use the Services and charge User any applicable cancellation or termination fee. In addition, Route2 may investigate incidents that are contrary to this policy and cooperate with law enforcement organizations, and provide requested information to third parties who have provided notice to Route2 stating that they have been harmed by a user's failure to abide by this policy or the policies listed above. Customer agrees to indemnify, defend and hold harmless Route2 and its affiliates against all claims and expenses (including reasonable attorney fees) resulting from Customer engaging in any of the prohibited activities listed in this AUP or resulting from violation by customer of the AUP or of any other posted Route2 policy related to the service.
